Important Answers To Frequently Asked Wrongful Death Questions

Emotions can run high after a wrongful death. Our attorney offers compassion and clarity. Here are answers to several of the most common wrongful death questions we hear in our offices.

Who can file a wrongful death claim in Florida?

Under Florida’s Wrongful Death Act, the personal representative of the deceased’s estate files the claim on behalf of survivors. Eligible survivors typically include their spouse, children, parents, and in some cases, other blood relatives or adoptive siblings who were dependent on the deceased. Our attorney guides families through this process during an incredibly difficult time.

What damages can be recovered in a wrongful death case?

Florida law allows recovery for economic damages, including medical expenses before death, funeral and burial costs, and lost wages and future earnings. It also allows noneconomic damages such as the loss of companionship and guidance of your loved one, and the pain and suffering of survivors.

While noneconomic damages can be substantial, Florida law imposes strict limits on who can recover them depending on the cause of death. For instance, in wrongful death cases stemming from medical malpractice, adult children (aged 25 or older) and parents of adult children are statutorily barred from recovering noneconomic damages for pain and suffering if there is no surviving spouse or minor child.

How long do I have to file a wrongful death lawsuit in Florida?

Florida’s statute of limitations for wrongful death is generally two years from the date of death. However, exceptions may apply depending on the circumstances. For example, if the wrongful death was caused by an intentional tort such as murder or manslaughter, there is no statute of limitations, and a civil action may be brought at any time.

Our attorney can help you sort through the details and prepare your case to be filed in a timely manner.
